THE OFFICE REFUSES TO DECIDE THE PETITION


Deputy Attorney General Benjamin Gutman dismisses the petition, writing that the records are in the Governor's custody. ORS 192.427 bars a petition only where an elected official claims the right to withhold a record. No record was withheld, and the Governor claimed nothing.
