To the Public Records Advocate / Attorney General's Office: I petition, under ORS 192.411, for review of the Oregon Department of Administrative Services' response to public records request R000879-070126, submitted July 1, 2026. The request sought the Department's own records concerning me — its communications referencing me with the Oregon Parks and Recreation Department, the Office of the Governor, and any other state entity, and records naming or identifiably describing me. The Department first closed it on the ground that it "is not the custodian," referring me to OPRD. After reopening, it closed the request a second time, on July 27, 2026, determining "no responsive records" as to both categories while again referring me to OPRD. It has never described the search behind either determination, never substantiated or withdrawn the custodial determination, cited no exemption, and never acknowledged the July 7, 2026 preservation notice. The attached petition asks the Attorney General to order the Department to do what ORS 192.329 requires: to produce, cite a specific exemption, or state expressly that no responsive record exists; to describe the search — including whether it reached the Department's communications with state entities other than OPRD; to either identify the public body for which it claims to have acted as an agent under ORS 192.311(2)(b) or withdraw the custodial referral; to state whether the preservation notice was received and distributed; and to impose the penalty available under ORS 192.407 for undue delay.
