The Attorney General's order of July 29, 2026 in my separate petition concerning Oregon State Police, DOJ File No. 257001-GA0140-26, found that "OSP acted in good faith by requesting clarification from you concerning the basis for the fee waiver." I did not
allege bad faith in that petition and I did not ask for a finding on it in either direction.

I file this to state the same thing in this matter before it is decided.

I do not allege that the Department of Administrative Services or any person in it acted in bad faith. I am not asking the Attorney General to find good faith, to find bad faith, or to characterize anyone's conduct, intent, or state of mind. Every item in my
petition is statutory: whether the Department is the custodian of its own correspondence under ORS 192.311(2)(b), whether the searches behind its two "no records" determinations are described, whether the estimate required by ORS 192.329(5) was provided, whether
any exemption has been cited under ORS 192.329(2)(b), and whether the preservation notice of July 7, 2026 was received and distributed. None of those requires an inquiry into why anyone did anything.

I ask that any order in this matter be confined to the statutory questions presented, and that it not include a determination as to good faith or bad faith, which I have not requested and do not request.
