Mr. White,

We have considered your request for a fee waiver, and we are denying it. While there is always a public interest in oversight of how a public body conducts its business, the records you seek pertain primarily to you and your private interests. We have already spent more than one hour of staff time searching for responsive records. Given the burden on our agency, we do not believe it would be reasonable to provide any additional waiver of our fees.

We have conducted a preliminary electronic search and identified 1,350 potentially responsive records. Our estimate to review and produce responsive nonexempt records is $599; this is based on the following breakdown: 13 hours of managerial time billed at $40 per hour and 1 hour of paralegal time billed at $79.00 per hour. Additional fees may be assessed if estimates prove to be too low, and any overpayment of processing fees will be refunded.
If you would like to proceed with this request, please issue a check or money order in the amount above, made payable to the Oregon Department of Justice, and send it to:
Oregon Department of Justice
General Counsel Division
Attn: Shevaun Gutridge, Public Records
1162 Court Street NE
Salem, OR 97301
In the memo line of your payment, include your last name followed by "PRR." Please note that we do not accept credit cards or digital/electronic forms of payment. Once payment is received, we will begin processing your request.

Ms. Gutridge,

Thank you for the acknowledgment, and for the offer to work together on scope.

I would like to narrow the request if narrowing is warranted, and I am asking for your help to do it accurately. Your letter states that the request is very broad in scope without identifying which part carries the weight. If you would tell me which of the nine categories account for the burden, I will consider each one on its own merits and respond to each.

I would also like to understand the characterization itself. My request is for the records of one person. It is bounded by my name, my two email addresses, my two domains, and my date of birth. I am asking, in good faith, how a request limited to a single individual becomes very broad in scope.

If the answer is that records about me are held across many divisions, I would like that stated, because it is meaningful information about how widely one citizen's file has traveled inside the Department. If the answer is that the Department has no way to search by subject and each division must be searched separately, I would like that stated as well.

Please also prepare the fee estimate. I would like to see the figure alongside whatever narrowing you propose, so that I can weigh the two together rather than one without the other.

Thank you for your time.

Mr. White,

This acknowledges the Oregon Department of Justice’s (ODOJ) receipt of your public records request (below). Your public records request is very broad in scope and will likely require significant agency resources to process, resulting in a fee that will be costly given the scope of the request. We would like to work with you to narrow the scope and invite any suggestions you may have to narrow the request to reduce the associated processing costs. If you would like to move forward with the request as submitted, we can prepare a fee estimate for you. Please let us know how you wish to proceed.

Waiver/ Reduction Requested
Yes

Reason Fee Waiver
I request a full waiver under ORS 192.324(5). Disclosure primarily benefits the general public. Your Department’s Public Records and Meetings Manual identifies the factors, and I address each. The identity of the requester: I am the subject of the records, and I publish a public archive at oprdvolunteerabuse.org that holds the records of eight state and federal institutions in this matter, document by document, at permanent public addresses. The purpose: publication. The records will be published in full at permanent public addresses. The character of the information: the records show how a citizen’s correspondence with his government moved from a parks department to a police captain, a fusion center, and a federal task force, what systems hold the resulting documentation, and how far it was distributed. Whether the information is already public: it is not. What is public in this matter was published by me from agency productions. The ability to disseminate: the September 3, 2026 production was published in full the same day it was produced.1 The archive maintains a public tracker of every pending request and notifies subscribers when records are added.
